Terms governing use of the GracePoint website and transportation-service requests.
These Terms & Conditions govern use of gracepointagl.com and requests for transportation or related services from Grace Point Air & Ground Logistics LLC (“GracePoint”). Additional written agreements, quotations, rate confirmations, customer agreements or shipment-specific terms may also apply.
Acceptance
By using the website or submitting a service request, you agree to these terms to the extent permitted by applicable law.
Website Use
You may use the website for lawful business purposes. You may not interfere with site security, attempt unauthorized access, misuse portal credentials or use the website to transmit unlawful or harmful material.
Quotes and Service Requests
A website submission or quote request does not by itself create a binding transportation agreement. Service is subject to GracePoint’s acceptance of the shipment, route, timing, pricing and applicable requirements.
Transportation Orders
Accepted orders may include shipment-specific instructions, rates, timing, documentation requirements, customer responsibilities and other terms communicated by GracePoint.
Shipment Information and Customer Responsibilities
Customers are responsible for providing accurate information regarding addresses, contacts, pieces, dimensions, weight, shipment contents, deadlines and special handling. Customers must not tender prohibited or restricted materials without prior written approval and all required legal authorization.
Pickup and Delivery
Pickup and delivery timing may be affected by traffic, weather, facility access, customer readiness, road conditions, governmental actions, emergencies and other factors beyond GracePoint’s reasonable control.
Rates, Tolls, Waiting Time and Additional Services
Charges may include agreed transportation rates and, where applicable, tolls, waiting time, special handling, additional stops, after-hours service, airport-related requirements or other approved service charges.
Cancellation
Cancellation charges may apply when a confirmed order is cancelled after dispatch, driver assignment, travel toward pickup or other committed resources.
Payment and Invoices
Customers are responsible for payment according to the terms stated on the quote, invoice, customer agreement or account terms. Past-due amounts may be subject to lawful collection activity and applicable fees where agreed.
Tracking Information
Electronic tracking information and ETA estimates are operational tools and may change as route or delivery conditions change.
Electronic POD, Photos and Signatures
GracePoint may use electronic delivery records, location data, photos, recipient names and electronic signatures as evidence of pickup, transit or delivery where applicable.
Claims and Cargo Claims
Customers should report loss, damage or service claims promptly and provide supporting documentation. Specific claim procedures, deadlines and liability terms may be governed by written transportation agreements, applicable law or shipment documents.
Limitations of Liability
Any limitation of liability must be interpreted together with applicable law and any signed transportation or customer agreement. Nothing in these website terms creates a liability limit that is unenforceable under governing law.
Force Majeure
GracePoint is not responsible for delays or failures caused by events beyond reasonable control, including severe weather, road closures, natural disasters, governmental orders, labor disruptions, acts of war, civil emergencies or infrastructure failures.
Third-Party Providers and Independent Contractors
GracePoint may work with qualified independent contractors or service providers in connection with transportation and support activities. Their role and applicable terms may vary by assignment and agreement.
Website Support Assistant
GracePoint may provide an AI-assisted website support feature for general informational questions. AI-generated responses are not shipment confirmations, binding quotes, contractual guarantees, dispatch instructions, or authoritative account records. Visitors should use the Track Shipment page, obtain a confirmed quote, or contact GracePoint staff when an answer depends on a specific shipment, price, deadline, service commitment, or other account-specific information.
Live-chat and email-support features are provided as customer-service channels and may not be continuously staffed. Where the website states an expected follow-up period, that statement is an operational target rather than a guaranteed response time.
Electronic Communications and Signatures
You consent to receiving business communications electronically where permitted and agree that electronic records and signatures may be used when legally valid.
Intellectual Property
GracePoint names, branding, website content, software interfaces and related materials are protected by applicable intellectual-property laws except for third-party materials used under license.
Privacy
Use of personal information is addressed in the GracePoint Privacy Policy.
Termination and Suspension
GracePoint may suspend website or portal access where reasonably necessary for security, misuse, nonpayment or violation of applicable agreements.
Disputes and Governing Law
Dispute-resolution and governing-law provisions should be interpreted under the final written customer agreement and applicable law. Where no separate agreement applies, GracePoint may specify reasonable governing-law terms consistent with its New Jersey business operations.
